These general terms and conditions of sale are intended for individuals or legal entities wishing to place an order on the site www.clone-ind.com . They are subject to French law and in no case does Clone ind give any guarantee of compliance with local legislation applicable in another country. The site is available in French and English, please go to the dedicated version of the site to place your order.

 

2- ORDERS

You can order on the website www.clone-ind.com, You can contact us by phone, email ([email protected]), or mail. Any order placed with the sole proprietorship Clone Ind implies acceptance of the general terms and conditions of sale. An order can only be registered on the website if you have clearly identified yourself by entering your email address and password. The data provided by the buyer and recorded by Clone Ind during the ordering process constitutes proof of the transactions between Clone Ind and the buyer. Clicking the validation button at the end of the ordering process constitutes order confirmation and is an electronic signature with the same legal value as a handwritten signature. Final order validation occurs after payment is validated. After you place your order, we will send you an email acknowledging receipt of your order, including a summary of the items ordered and the delivery address.

After your order is registered, a detailed printable invoice will be available on the Clone ind website in the "My Account" section. Order data is archived for 10 years at the Clone ind sole proprietorship's headquarters. You can access this archived data by submitting a request to Clone ind.

 

3- PRICE

Our prices are expressed in euros. They are calculated as accurately as possible; therefore, we are unable to offer any discounts for any reason whatsoever. Clone ind reserves the right to modify them without prior notice in the event of increased costs, particularly changes in the VAT rate, and in the event of a manifest error. Invoices will be issued based on the rates in effect at the time of the order. In addition to the price of the products, you will be required to pay a flat-rate contribution to shipping costs, the amount of which will be specified before order confirmation. This contribution depends on the products ordered, as well as the delivery location and method.

Attention: For an optimized customer service, we regularly make automatic updates of the site wwwclone-ind.com. During these operations, transmission errors can generate pricing errors. In this case, the order cannot be honored and you will be notified very quickly.

 

4- EXPORT ORDERS AND CUSTOMS DUTIES

Any order shipped outside the European Union and to the French overseas departments and territories will automatically be billed at the price including tax. 

Import formalities, customs duties, and any applicable taxes related to the delivery of an item outside the European Union and to French overseas departments and territories (DOM-TOM) are the sole responsibility of the buyer. These must be paid to the relevant authorities in the country of delivery. The buyer is solely responsible for verifying the import regulations for the ordered products in the destination country. Clone ind is not obligated to verify or inform the buyer of applicable customs duties and taxes. To determine these, Clone ind advises the buyer to contact the relevant authorities in their country. Please note that by ordering from this website, you are considered the official importer and are responsible for complying with all laws and regulations of the country where you will receive the goods. Cross-border shipments may be subject to opening and inspection by customs authorities.

 

5- DELIVERY

You can choose different delivery methods depending on the delivery times and the country where you wish to be delivered:

Standard delivery in mainland France, at home and away from home, in So Colissimo by La Poste

You can be delivered to your home, or to the address of your choice, subject only to payment of the flat-rate contribution to shipping costs. You will be delivered by La Poste in Colissimo 72 hours from the exit of your package from our warehouse. To calculate the delivery date, allow approximately 2 to 5 days after validation of your order for items in stock and 10 to 15 days for those that are not. For non-standard packages, delivery is provided, under the same conditions, by our partner carrier.

You can also choose to be delivered to a relay point near the address of your choice. This includes post offices and shops in the So Colissimo network. The delivery times are the same as the delivery method above but the rates are more advantageous. By choosing delivery to a relay point, you will be automatically redirected to the So Colissimo website of La Poste. The information appearing there is the property of La Poste.

Please note that delivery times may be extended due to government measures prohibiting heavy goods vehicles from driving during weekends.

Standard international delivery by Colissimo International by La Poste

You can be delivered to the address of your choice worldwide. Delivery will be made by Colissimo International within 5 to 14 days from the release of your package from our workshops. When you order several products at the same time, if one of the items is not available, delivery may be postponed, the order being prepared when all the products that constitute it are in stock at Clone IND. Delivery rates are calculated according to the destination and the items ordered, at the time of validation of the order.

You can track the status of your order in the "My Account" section of the website. «www.clone-ind.com. Delivery tracking can be done directly on our partners' website with the tracking number provided.

 

6- SHIPPING & PACKAGING COSTS

CLASSIC delivery in mainland France

– At home: For any shipment a flat rate contribution of 7.90€ You will be charged. Free shipping is applied to orders over €300.

– Away from home (Post offices and selected retailers): For all shipments, a flat rate contribution of 5.90€ You will be charged. Free shipping is applied to orders over €300.

FREE Shipping Free shipping on orders over €300 delivered to a collection point and over €300 delivered to your home: Calculated on the total price including VAT, for standard deliveries (So Colissimo) in mainland France only. Valid only for online orders.

FAST delivery in mainland France

– At home: A flat rate contribution is charged to you based on the weight of your order: 19€ up to 10 kg; 25€ up to 20 kg; 30€ up to 30 kg.

Delivery abroad, DOM-TOM

 The shipping cost will be calculated automatically at the end of your order based on the delivery method chosen, the delivery area and the weight of your order.

Exception

Please note that for certain items that are too heavy or have special transport conditions (skis, snowboards, monoskis and oversized packages), only delivery by carrier is applicable and the shipping costs will be calculated at the end of the order.

We insure your package for FREE against the risk of loss during transport. In this case, you would be reimbursed after an investigation by the insurance company.

 

7- PAYMENT

You can choose several payment methods to pay for your order.  

MasterCard or Visa bank card

This payment method is preferred for online orders. It allows for rapid processing of your order.
In addition, your payment is completely secure by encryption. The transaction elements are transmitted directly to the GIE Cartes Bancaires through the secure payment site Ogone without us or any natural person being able to see, intercept and therefore hack your bank card.

Bank transfer

You can pay by bank transfer. Please note that in this case, we will need to see your transfer credited to our account before shipping your order. Therefore, this payment method is not compatible with fast delivery. Furthermore, bank charges for transfers made from outside the European Union are the responsibility of the customer.
Don't forget to include the order number in the subject (reason) of the transfer.

Payment: Paypal

AttentionPayPal is a service that lets you pay online without sharing your bank details. To secure your purchase, PayPal encrypts and protects your bank information and never shares it with the recipient of your payments. After creating a PayPal account, you simply use your PayPal login details (email and password) and no longer need to enter your bank card information. Paying online with PayPal doesn't cost you any more than using your bank card.

In case of payment by check, money order or bank transfer, delivery times only begin to run from the date of actual receipt of your payment. We ask that you enclose your order number with your payment.

In accordance with Article 121-II of Law No. 2012-387 of March 22, 2012, the fixed compensation for recovery costs due to the creditor in the event of late payment is set at €40 by Decree No. 2012-1115 of October 2, 2012. These fees do not apply to direct sales to consumers and fall under the category of business-to-business invoicing.

 

8- RESERVATION OF OWNERSHIP

The goods remain our property until full payment of their price, including shipping costs. The risks relating to the thing sold are however transferred to the buyer upon delivery, which is effective upon delivery of the product to the consumer.

 

9- DISPUTES

Any dispute regarding the nature or quantity of the items received must be notified to us within 48 hours of receipt of the package.

We intend to resolve any difficulties that may arise in the processing and payment of your orders directly with you. The consumer may bring an action before either one of the courts with territorial jurisdiction under the Code of Civil Procedure, or the court of the place where they resided at the time the contract was concluded or the harmful event occurred.

 

10- RIGHT OF WITHDRAWAL

You have 14 days from the date of receipt of the last item ordered to exercise your right of withdrawal. To exercise this right, you must notify us of your decision to withdraw by means of an unambiguous statement (e.g., a letter sent by post, fax, or email). You can use the model withdrawal form., Good Return Exchange.

The right of withdrawal cannot be exercised for contracts:

Supply of goods made to the consumer's specifications or clearly personalized.

Excluded from the right of withdrawal are perishable goods, alcoholic beverages, personalized goods, inseparable goods, sensitive goods (hygiene), fully performed services, periodicals and magazines, audio or video recordings.

The cost of returning the product is the responsibility of the customer. Any shipment with postage due will be refused.

Colissimo from La Poste allows you to return your package to your mailbox. To do this, you must pay for postage and request mailbox delivery on the La Poste website. More information about mailbox returns can be found here..

 

11- WARRANTY, RETURN

Our products are guaranteed for two years from the invoice date. This guarantee is strictly limited to the repair or replacement of goods affected by a defect or non-conformity.

Legal guarantee of conformity:

  • You have a period of two years from the delivery of the goods to take action; ;
  • You can choose between repair or replacement of the item, subject to the cost conditions stipulated in Article L 211-9 of the Consumer Code; ;

is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 months following delivery of the goods, except for second-hand goods.

You can decide to implement the guarantee against hidden defects in the thing sold within the meaning of article 1641 of the civil code and that in this case, he can choose between the termination of the sale or a reduction of the sale price in accordance with article 1644 of the civil code.

New items: Return possible within 15 days

Any item that doesn't suit you will be accepted for return. You don't need to justify the return. The item must be brand new and returned in its original packaging and in good condition within 14 days. In exchange for these returned items, you can either request an exchange, receive a credit note for the same amount valid for one year at Clone ind, or be refunded (including shipping costs paid at the time of order, corresponding to the cheapest standard shipping method).

Attach a return or exchange slip to your return of new items. You can use the withdrawal form template, Good Return Exchange.

The cost of returning the product is the responsibility of the customer. Any shipment with postage due will be refused.

Colissimo from La Poste allows you to return your package to your mailbox. To do this, you must pay for postage and request mailbox delivery on the La Poste website. More information about mailbox returns can be found here...

Returns are free if you bring the product back to our Clone Workshop. If you would like an exchange, please contact us beforehand to ensure the product you need is in stock.

Items that have been used

Items are sold under the manufacturer's warranty only.

Normal wear and tear during use is obviously excluded from this warranty. Items returned for repair or warranty claim must be clean and dry.

Whether the items are new or not, enclose with the returned material an explanatory letter and the purchase invoice or a photocopy.

Clone ind reserves the right to modify the range of models present on the site and the technical characteristics of the items offered.

In addition, the Consumer Code provides for the following obligations:
